Public Comment Period for Presumed Institutional HCBS

On February 23, 2021, the Indiana Family and Social Services Administration (FSSA) announced that the Heightened Scrutiny Evidence Packets submitted by Presumed Institutional HCBS Providers in compliance with the Settings Rule will be posted for public comment on FSSA’s Statewide Transition Plan website.  The public comment period will begin March 1, 2021, and conclude March 31, 2021.

HCBS members, providers, and stakeholders are encouraged to provide input on these settings, and comments may be emailed to HCBSrulecomments@fssa.in.gov or submitted via mail to the following address:

For a more detailed timeline regarding compliance with the Settings Rule, please click here, and as a reminder, Presumed Institutional HCBS Providers are asked to inform FSSA’s Division of Aging if the facility does not plan to remediate the facility for compliance with the Settings Rule by March 17, 2021.
