Minor Employees Required to be Registered in Youth Employment System Starting July 1, 2021

Senate Enrolled Act 409, which passed during the 2020 legislative session, requires Indiana employers who hire five (5) or more minor employees (under the age of 18), per location, to list those employees in the Indiana Department of Labor’s new Youth Employment System (YES), starting July 1, 2021.

Although not effective until July 1, employers can begin registering on YES at the following website effective immediately and begin inputting minor employee information as well.  This replaces the requirement that employers secure a work permit from a minor employee through the minor employee’s school.  Required information will include the employer’s corporate and individual facility location and the minor employee’s information, such as name and age, once the minor is officially employed.  Upon termination of employment, the employer must remove the minor’s information from the YES registry.

Employers who employ four (4) or fewer minor employees are not required to register on YES or obtain documentation from the minor employee’s school, starting July 1.

Penalties for noncompliance can range from $100 to $400, depending on the noncompliance infraction.  For more information, please visit the Indiana Department of Labor’s website, and any questions may be directed to YouthEmployment@dol.IN.gov.
