IHCA/INCAL Statement on IndyStar Article on COVID-19 Liability Proposals

INDIANAPOLIS, IN (February 8, 2021) – Zach Cattell, president of the Indiana Health Care Association/Indiana Center for Assisted Living (IHCA/INCAL), issued the following statement in response to the IndyStar article “Do nursing homes need COVID liability protections” that was published on February 8, 2021:

“In discussing the merits of the COVID-19 liability proposals in front of the Indiana General Assembly this legislative session, IHCA/INCAL did not indicate, and never would indicate, a family member’s concerns regarding a loved one in a long-term care facility are overblown.  Indiana’s long-term care professionals care deeply for their residents and continually work to ensure concerns are addressed.

The COVID-19 liability proposals being considered by the legislature are specifically tailored to address actions that are in response to the pandemic or for COVID-19.  Any alleged acts of negligence that are not in response to the pandemic or for COVID-19 will not be provided the heightened standard being considered under the proposals.  Further, neither proposal will prevent cases from being filed, allowing them to be considered based on the facts of each circumstance.”
