Federal Public Health Emergency Extended until January 22, 2021

On October 2, 2020, the Secretary of the U.S. Department of Health and Human Services extended the federal public health emergency for an additional 90-day period until January 22, 2021.  It was previously set to expire on October 22, 2020.

The extension of the federal public health emergency means:

  • The Section 1135 blanket waiver remains in place, which contains a variety of flexibilities for nursing facilities.
  • The Section 1812(f) waiver remains in place, which waives the 3-day prior hospitalization requirement.
  • The enhanced FMAP to states continues until the end of the quarter in which the PHE ends, so the enhanced FMAP will continue until at least March 2021.
