On October 2, 2020, the Secretary of the U.S. Department of Health and Human Services extended the federal public health emergency for an additional 90-day period until January 22, 2021. It was previously set to expire on October 22, 2020.
The extension of the federal public health emergency means:
- The Section 1135 blanket waiver remains in place, which contains a variety of flexibilities for nursing facilities.
- The Section 1812(f) waiver remains in place, which waives the 3-day prior hospitalization requirement.
- The enhanced FMAP to states continues until the end of the quarter in which the PHE ends, so the enhanced FMAP will continue until at least March 2021.
