[April 20, 2020] Summary of ISDH Sixth Emergency Order for Comprehensive Care Facilities

The Sixth Emergency Order for Comprehensive Care Facilities issued by ISDH on April 18, 2020, waives or modifies the following:

  • 410 IAC 16.2-3.1-14(c) is waived, which sets out requirements for CNA training programs
  • Permits former CNAs with expired or lapsed certifications to be temporarily employed by facilities when:
    • The expiration or lapse was when the CNA was in good standing with no findings in the nurse aide registry on abuse, neglect, or misappropriation
    • The expiration or lapse occurred after January 1, 2019
    • The CNA worked at least 40 hours in the 1 year prior to the expiration or lapse
    • The facility ensures the former CNA provides competent services required by 410 IAC 16.2-3.1-1-14(b)(1)
  • Facilities may request use of CNAs that do not meet the above criteria on a case by cases basis so long as competency can be demonstrated.
