[May 15, 2020] 2020 Interim Study Committee Update

On May 13, 2020, the Legislative Council held a virtual meeting to assign topics to the Indiana General Assembly’s Interim Study Committees.  These Interim Study Committees can meet through November 1, 2020, to study the topics assigned to them and develop proposals in anticipation of the 2021 legislative session, as applicable.  All of the topics assigned can be found here.  IHCA/INCAL will be monitoring each Interim Study Committee, with particular attention to the following committees and topics:

Interim Study Committee on Public Health, Behavioral Health, and Human Services

The Interim Study Committee on Public Health, Behavioral Health, and Human Services is charged with receiving reports from the Family and Social Services Administration (FSSA) and Indiana State Health Department (ISDH) on the following:

  1. An overview of which, if any, agency operations or services were reduced or suspended during the COVID-19 pandemic, including whether the suspension or reduction was required by an Executive Order or an internal agency decision.
  2. An overview on agency preparations to address future emergencies and recovery from emergencies based on the agency’s experience with the COVID-19 pandemic.
  3. Recommendations, if any, for legislation that may be needed to help ensure the agency is prepared to address future emergencies.
  4. Recommendations, if any, for legislation to permanently repeal or modify any regulations or laws that were or are partially or fully suspended due to the COVID-19 pandemic.

The reports from FSSA and ISDH are due by September 14, 2020.  The Chair of the Interim Study Committee on Public Health may schedule meetings for the agency heads or the designees of the agency heads to appear before the Interim Study Committee on Public Health to discuss the reports submitted.  No further topics were assigned to the Interim Study Committee on Public Health.

Interim Study Committee on Financial Institutions and Insurance

The Interim Study Committee on Financial Institutions and Insurance is charged with studying Medicaid payment coverage, including the following:

  1. Whether medical payment coverage should be supplemental to the benefits to which a covered individual is entitled under a health plan and that are the same as or similar to benefits available to the covered individual under the medical payment coverage.
  2. Whether a health plan should be prohibited from requiring the use or exhaustion of medical payment coverage as a condition of payment of benefits under the health plan for health care services rendered to a covered individual.

The Interim Study Committee on Financial Institutions and insurance will also receive a report from the Indiana Department of Insurance addressing the same COVID-related topics outlined above.

IHCA/INCAL’s team will remain active and engaged as Interim Study Committees begin to meet and any legislative proposals are discussed.
